Terms and Conditions

1. What Tuluyan is
Tuluyan is a software platform that provides property operators with tools to manage reservations, collect payments, communicate with tenants and guests, and participate in an affiliate program. Tuluyan is a technology service provider and payment processor. We are not a property manager, a real estate broker, a landlord, a tenant, a travel agent, or a party to any agreement made between operators, guests, tenants, unit owners, or affiliates using this platform.
By creating an account and using Tuluyan, you agree to these terms in full.
2. Who these terms apply to
These terms apply to all users of the Tuluyan platform, including:
- Operators — property owners or managers who use Tuluyan to manage their properties
- Guests — individuals who make bookings through an operator's Tuluyan-powered booking page
- Tenants — individuals in a long-term lease managed through Tuluyan
- Unit owners — individuals whose unit is administered by an HOA or building manager on Tuluyan
- Affiliates — individuals or entities who participate in the Tuluyan affiliate program
Each user type may be subject to additional terms specific to their role, presented at the point of registration or activation.
3. Tuluyan's role — processor only
Tuluyan provides the facility. We are not responsible for what happens within it.
Specifically:
- Tuluyan is not a party to any booking, lease, tenancy agreement, dues collection arrangement, or affiliate partnership made through the platform
- Tuluyan does not own, manage, inspect, or guarantee the condition of any property listed on the platform
- Tuluyan does not guarantee the accuracy of property descriptions, photos, or amenities beyond the initial listing review
- Tuluyan does not guarantee the behavior, identity, or intentions of any operator, guest, tenant, unit owner, or affiliate
- Tuluyan does not guarantee that any booking will result in a stay, that any payment will be honored, or that any agreement between parties will be fulfilled
- Tuluyan's role in payments is limited to facilitating transactions between parties through licensed third-party payment gateways. Tuluyan is not a bank or financial institution
All agreements, obligations, liabilities, and disputes arising from transactions made through Tuluyan are strictly between the parties involved. Tuluyan is not liable for any loss, damage, injury, or cost arising from those agreements.
4. What Tuluyan will and will not provide in a dispute
When a dispute arises between users, Tuluyan may be asked to provide information to support resolution.
What Tuluyan can provide:
- Records of messages sent through the Tuluyan in-platform messaging system
- Records of transactions processed through Tuluyan, including amounts, dates, and statuses
- Booking or reservation records as they exist in the Tuluyan system
- Affiliate attribution records
What Tuluyan will not provide:
- Communications made outside the platform, including but not limited to SMS, messaging apps, phone calls, email, or any channel not operated by Tuluyan
- Information about users not directly party to the dispute
- Legal opinions, assessments of fault, or recommendations on outcomes
- Any information protected by privacy obligations to other users
Tuluyan's role in disputes:
Tuluyan may, at its sole discretion, provide the records described above to support dispute resolution between parties. Tuluyan has no obligation to mediate, arbitrate, or resolve any dispute. Providing records does not constitute an endorsement of either party's position.
For affiliate partnership disputes, Tuluyan will review termination requests against the documented valid reasons policy accessible within the platform. Tuluyan's decision on whether a termination meets the criteria is final and binding. This is the extent of Tuluyan's involvement in affiliate disputes.
5. Operator responsibilities
Operators are solely responsible for:
- The accuracy of their property listings, including descriptions, photos, pricing, house rules, and available amenities
- Ensuring their property complies with all applicable local laws, regulations, permits, and licensing requirements in the jurisdiction where the property is located
- The conduct of their guests, tenants, and unit owners while on their property
- Fulfilling all obligations to guests, tenants, and unit owners that arise from bookings or agreements made through the platform
- Setting appropriate commission rates for affiliates and honoring those rates for the duration of each partnership
- All tax obligations arising from payments received through the platform, in accordance with the laws of their jurisdiction
Tuluyan is not liable for any failure by an operator to meet these responsibilities.
6. Guest and tenant responsibilities
Guests and tenants are solely responsible for:
- Providing accurate identity information during the verification process
- Complying with the house rules, lease terms, and policies of the operator whose property they are booking or occupying
- Any damage caused to a property during their stay or tenancy
- Any conduct that results in a negative reputation record on the platform
Submitting false identity information during verification is grounds for immediate account termination and may be reported to relevant authorities.
7. Payments
All payments processed through Tuluyan are subject to the following:
- Payments are facilitated through licensed third-party payment gateways. The gateways available in your market are listed within the platform. Tuluyan does not hold funds as a financial institution
- Tuluyan's marketplace commission is deducted from completed bookings before settlement to the operator. The current rate is published on the Pricing page and within the platform
- Payment processing fees are charged at the gateway's published rate. Tuluyan does not add a markup. Fees are displayed before any transaction is confirmed
- Tuluyan's subscription fee is charged to the operator on a recurring basis. The current rate for your market is displayed within the platform
- Refunds, cancellations, and chargebacks are governed by the operator's stated policy and the terms of the relevant payment gateway. Tuluyan is not liable for any loss arising from a refund, cancellation, or chargeback
- Tuluyan reserves the right to withhold settlement if there is reason to believe a transaction is fraudulent, disputed, or in violation of these terms. Settlement will resume once the matter is resolved
8. Affiliate program
Participation in the Tuluyan affiliate program is subject to the following:
- Affiliate partnerships are agreements between operators and affiliates. Tuluyan provides the facility for those agreements but is not a party to them
- The commission rate agreed to at the start of a partnership is fixed for that partnership. Operators may not unilaterally change the rate for an existing affiliate partnership
- Operators may update their commission rate for new affiliates at any time. The change applies only to partnerships formed after the update
- Partnerships may only be terminated for documented reasons as stated in the affiliate program policy, accessible within the platform
- Tuluyan will not process a termination request that does not meet the documented criteria
- Affiliates are responsible for ensuring their promotional content is accurate, not misleading, and compliant with applicable advertising standards in the markets where they operate
- Tuluyan reserves the right to remove any affiliate from the program whose conduct violates these terms
- Commission payouts are made after a stay is confirmed as completed. Tuluyan is not liable for commission lost as a result of a cancellation, no-show, or dispute between the operator and guest
9. Verification
Tuluyan conducts identity and property verification to reduce fraud and improve platform trust. This verification does not constitute a guarantee.
- Identity verification confirms that a document was submitted and reviewed. It does not guarantee the authenticity of that document or the intentions of the person who submitted it
- Property verification confirms that a listing was reviewed before going live. It does not constitute an inspection, endorsement, or warranty of the property's condition, safety, or legal compliance
- Tuluyan is not liable for any loss or harm arising from the actions of a verified user or the condition of a verified property
10. Data and privacy
Tuluyan collects and processes personal information in accordance with its Privacy Policy, available at /privacy.
What we never share:
Your name, contact details, government ID information, and individual transaction records are yours. We do not sell them, trade them, or share them with third parties for commercial purposes.
What we may share:
Tuluyan may derive and share aggregated, anonymized data — platform-wide trends, occupancy patterns, payment method usage, booking volumes — with partners or for commercial purposes. This data cannot be traced back to any individual user or property. No name. No contact. No individual transaction record.
If you are ever unsure whether something qualifies as personal data, assume it does. We do.
Where your local data protection law provides rights beyond those described here — including rights of access, correction, deletion, or portability — you may exercise those rights by contacting hello@tuluyan.com.
11. Limitation of liability
To the fullest extent permitted by applicable law:
- Tuluyan's total liability to any user for any claim arising from or related to the use of the platform shall not exceed the total fees paid by that user to Tuluyan in the three months preceding the claim
- Tuluyan is not liable for any indirect, consequential, incidental, or punitive damages, including but not limited to loss of revenue, loss of data, loss of bookings, property damage, or personal injury
- Tuluyan is not liable for any failure or delay in platform availability caused by circumstances outside our reasonable control, including payment gateway outages, telecommunications failures, natural disasters, or other force majeure events
12. Prohibited conduct
Users may not:
- Submit false identity information or misrepresent themselves or their property
- Manipulate the affiliate attribution system, including through self-referrals or coordinated fake bookings
- Use the platform to facilitate transactions that violate applicable law in any jurisdiction
- Attempt to circumvent Tuluyan's payment system to avoid fees
- Harass, threaten, or defraud other users through the platform
- Use another user's personal information for any purpose beyond the specific transaction it was shared for
Violations may result in account suspension, termination, withholding of funds pending investigation, and reporting to relevant authorities.
13. Account termination
Tuluyan reserves the right to suspend or terminate any account at any time for violation of these terms, fraudulent activity, or conduct that poses a risk to other users or the platform.
Users who wish to close their account may do so through the platform settings. Pending transactions, active bookings, and active affiliate partnerships will be resolved before the account is fully closed. Subscription fees are not refunded for the current billing period.
14. International users
Tuluyan is accessible from multiple countries. If you access the platform from a jurisdiction other than where Tuluyan is incorporated, you do so on your own initiative and are responsible for compliance with local laws.
Where local law provides rights or protections that cannot be waived by contract, those rights apply to you regardless of anything stated in these terms. The remainder of these terms continue in full force.
Tuluyan makes no representation that the platform or its features are available or appropriate in all jurisdictions. Certain payment methods, verification processes, and features may vary by market.
15. Governing law and dispute resolution
These terms are governed by the laws of the Republic of the Philippines, without regard to its conflict of law principles. Nothing in this clause removes any rights you hold under the mandatory laws of your own country.
Dispute resolution:
If a dispute cannot be resolved through direct communication with Tuluyan, both parties agree to resolve it through binding arbitration, conducted in English. Arbitration may be initiated by either party by written notice to hello@tuluyan.com. The arbitrator's decision is final and enforceable in any jurisdiction that recognizes international arbitration awards.
Class actions and representative claims are waived to the extent permitted by applicable law.
Exception:
Either party may seek emergency injunctive relief from a court of competent jurisdiction to prevent immediate and irreparable harm, pending the outcome of arbitration.
16. Changes to these terms
Tuluyan may update these terms from time to time. Users will be notified of material changes through the platform or by email. Continued use of the platform after notification constitutes acceptance of the updated terms.
